Terms of Service
The content created on the School's Out service is created by people whom School's Out exercises no control. School's Out will not assume responsibility for unintended or questionable content delivered via the School's Out service.
Disclaimer of Warranties
School's Out disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information displayed in the email or text message. School's Out disclaims any responsibility for the deletion, failure to store, miss-delivery, or untimely delivery of any information or material. School's Out cannot guarantee the successful delivery of messages.
Administrators, who generate messages, use School's Out on a voluntary basis. School's Out is not responsible for the creation of messages or decisions to create and send messages to the subscriber base. School's Out staff will make a follow up effort with the Administrator if complaint reports arise due to lack of timely input of alerts.
Only messages created by the user specified group or directly by School's Out may be delivered to the user. No unsolicited messages generated by any third party will be permitted to be distributed via the School's Out service.
If at any point, you wish to opt out of our services, you may do so.
Registered User Information
Registered user information of the School's Out service will not be sold to third parties. Please note that we reserve the right to transfer your personally identifiable information and other information to our successors in business and purchasers of School's Out's assets.
Limitation of Liability
UNDER NO CIRCUMSTANCES WILL SCHOOL'S OUT OR ITS EMPLOYEES, OFFICERS OR DIRECTORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE SERVICES WHETHER OR NOT SCHOOL'S OUT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to indemnify, defend and hold harmless School's Out, its parent company (NotiSys, LLC), its employees, officers and directors, or Clients from and against any and all claims, liabilities, penalties, settlements, judgments, fees (including reasonable attorneys' fees) arising from (i) any content that you or anyone using your account may submit, post or transmit to the web site; (ii) your use of the Services; (iii) your violation of the terms of these Terms and Conditions; and (iv) any violation or failure by you to comply with all laws and regulations in connection with the Service.
School's Out Plus Addendum (Text message alerting service)
A subscription to the School's Out Plus service is good for one full year (365 days), at which point it will be auto-renewed and your credit card will be charged. If a user wishes to unsubscribe themselves from the School's Out Plus service they may contact us to do so, but there will be NO refunds.
Other Plan Specific Terms
These terms entitle the subscriber to the following:
(1) One year (365 days) full subscription to the School's Out Plus service for one school for one phone.
(2) One time courtesy phone number change, where a subscriber can change their subscribed phone number to a different phone number (but not a different school).
(3) If a school or school district leaves our service (or is removed), we will not refund any fees. As a courtesy, we will allow the subscriber to ONE free move to another school or school district that lists with us, if this occurs.
Your cell phone service provider may charge you for the text messages you receive. School's Out will not be liable for any charges you may receive from your cell phone provider for receiving text messages from School's Out.
School's Out Basic Addendum (Email alerting service)
Length of Subscription
Unlike a School's Out Plus subscription, a School's Out Basic subscription lasts indefinitely. At any time, you can unsubscribe from the School's Out Basic service on our website.
In order to provide the best possible service to all of our users, we regularly remove School's Out Basic users whose email is regularly rejected, or "bounced". Mail is usually rejected by remote mail servers because the destination email address is no longer valid.
Timely Delivery of Email
Sending email can be a complicated process, and there can be many reasons for delayed delivery or even failed delivery. We will do our best to make sure that this does not happen, but we cannot guarantee delivery of email.
